REGULATORY AND LEGAL PROVISION OF TRANSPORT SYSTEMS FUNCTIONING CONDITIONS AND DIRECTIONS OF ITS IMPROVEMENT
Abstract
Introduction. Regulatory support is an important factor in the development of transport systems. In the conditions of dynamic changes, it should play not only a regulatory but also a stimulating role due to the rapid adaptation of legal norms to the challenges facing the transport system. Purpose. The article offers directions for improving the regulatory and legal support for the functioning of transport systems in accordance with changes in their environment. Results. The paper emphasizes the need for continuous improvement of regulatory and legal support for the functioning of transport systems in accordance with changing circumstances. The system of legal support of transport functioning is characterized, its hierarchical character is defined. The strategic tasks of public administration in the field of transport are defined and grouped. It is established that in today’s conditions an important tool for improving the legal regulations of the transport sector are international acts that form requirements for compliance with global development goals, strengthening the integration of the transport network and its high logistics efficiency, and ensuring innovative development on the basis of decarbonisation and sustainability. The realization of the outlined tasks in the current normative-legal acts is analyzed, and also perspective directions of their improvement are determined. Within the outlined perspectives, an approach to the introduction of a two-tier system of discussion of legislative initiatives, covering the short and long term, has been formed. In the near future, it is proposed to discuss the regulatory settlement of challenges already facing the transport industry using the successful experience of advanced countries. In the case of discussing the norms of the long term, it is proposed to join the discussion of conceptual provisions and innovations at the stages of their development in order to influence this process, as well as preparation for their implementation in the legal field in the future. Conclusions. Today, regulatory and legal support for the functioning of transport systems in Ukraine is in a state of transformation, mainly under the influence of international norms. In this context, it is important that the implementation and adaptation of changes in existing legislation is rapid or ahead of schedule, which will increase the level of development of the transport sector.
